1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to those aged 18 years or over.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences on 12:00pm on July 19, 2019 and final entries close at 11:45pm AEDT on September 15, 2019 (“Promotional Period”).
5. To enter, individuals must undertake the following steps during the Promotional Period:
   • Visit cruiseandtravelasia.com and follow the prompts to the competition entry page (“Competition Page”). The Promoter, Cruise & Travel Asia may send promotional emails to its existing database with a link to the Competition Page or provide links to the Competition Page via its various social media channels;
   • Input the requested details including their first name and a valid email address;
   • By entering the competition, the entrant consents to receive email communications from Cruise & Travel Asia and Dream Cruises, and acknowledges that the entrant is aged 18 years or over and that they agree to these full Terms and Conditions;
   • Submit the fully completed online entry form.
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
7. Incomplete or indecipherable entries will be deemed invalid.
8. Only one entry is permitted per person.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
10. The draw will take place at 10:00 am on 16 September, 2019. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing by email within two (2) business days of the draw and their name will be announced online at https://www.facebook.com/cruiseandtravelasia/. Once the promoter has sent an email to the winner, they have 2 business days (48 hours) to accept the prize, or it will be redrawn.
11. The Promoter’s decision is final and no correspondence will be entered into.
12. The first valid entry drawn from all valid entries received, will win the following for two (2) people;
    – 6-day 5-night cruise ticket departing on Sunday from Singapore onboard Genting Dream for two persons in a Balcony Stateroom
13. This letter is valid for redemption during the following period: from 15 September 2019 to 29 Feb 2020, both days inclusive (“Valid Redemption Period”).
14. Bookings are subject to stateroom availability, based on first-come, first-served basis. Please make advance reservation at least 1 month before the intended departure date. The Prize is applicable for cruises departing on the following dates: from 18 Aug 2019 to 29 Mar 2020, both days inclusive. Notwithstanding the aforementioned, the Prize shall not be applicable for cruises departing on: statutory and public Holidays or such other dates as may be specified by Dream Cruises at its sole and absolute discretion from time to time. 
15. Passengers are required to pay related visa fee, port charges, gratuity, and any other incidental charges.

17. The Prize cannot be used in conjunction with any other promotional offers, is not for sale or re-sale, and shall not be exchangeable, redeemable or refundable for cash or any other items or services, and is not transferable.
18. Dream Cruises reserves the right to reject the redemption if the presented letter does not comply with the terms and conditions herein. 
19. Passengers shall be subject to the terms and conditions in the Passage Contract of Dream Cruises’ website at dreamcruiseline.com. Dream Cruises reserves the right to cancel or change the port of call / itinerary / price / entertainment program without any prior notice. Dream Cruises is entitled to replace the prize with another cruise of similar value to this one without any additional compensation or liability if the reserved cruise is revised or canceled. 
20. This letter can be redeemed once only. This letter shall be automatically forfeited if it is not redeemed within the Valid Redemption Period, and the Prize shall accordingly be forfeited without further notice. No extension of the Valid Redemption Period will be granted. Neither departure date or passenger name can be changed once reservation made. The Prize shall be deemed null and avoid if the winner cancels the trip or does not board the ship due to issues related to travel documents.
21. Dream Cruises shall be under no obligation to issue a replacement letter if this letter is lost, damaged or stolen.
22. Dream Cruises reserves the right to amend the terms and conditions herein (being governed by the laws of Singapore), as well as vary the Prize at any time without prior notice. 
23. Should any dispute arise in relation to this letter, the Prize and the terms and conditions herein, the decision of Dream Cruises shall be final and binding.
24. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
25. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
26. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
27. Total prize pool value is S$3,593. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
28. A draw for the prize, if unclaimed, may take place at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner (if one is required) will be notified in writing by email within two (2) business days of the draw and their name will be announced online at facebook.com/cruisepassenger
29. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used
32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Rocky Mountaineer or Holland America Line cruise is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize / taking of the prize.
34. As a condition of accepting the prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.

To the extent permitted by law, the Promoter is not responsible or liable for:

(i) inaccurate / incorrect transcription of entry information;

(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions;

(iii) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;

(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any Website;

(v) unauthorised human intervention in any part of the competition;

(ii) (vi) electronic or human error which may occur in the administration of the competition;

(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or

(viii) any injury or damage to persons or property, including to the participant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in this competition;

(ix) In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
